These Terms of Service ("Terms") govern your use of the Momentum mobile application ("App") provided by ABOVE BELOW AROUND LIMITED ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Momentum, you confirm that you are at least 16 years old and agree to comply with these Terms. If you do not agree to these Terms, you must not use the App.
2. Description of Service
Momentum is an AI-powered personal coaching application that helps you:
- Identify and clarify your personal values
- Set and track meaningful milestones and goals
- Engage in coaching conversations with an AI assistant
- Complete daily check-ins and reflections
- Review your progress through structured sessions
3. What Momentum Is and Isn't
Momentum is a thinking partner and coach designed to help you connect what you value to what you do day-to-day.
What Momentum does:
- Helps you identify and clarify your personal values
- Supports you in thinking through challenges and decisions
- Helps you break down your goals into actionable daily steps
- Provides structured reflection and progress tracking
- Acts as a thought partner in your personal development journey
What Momentum is NOT:
- Not a medical or mental health professional — We don't diagnose, treat, or provide therapy
- Not a financial advisor — We don't provide financial planning or investment advice
- Not an expert in your life — You are in control of all decisions you make
- Not a replacement for professional services — Always consult qualified professionals for medical, psychological, financial, or legal matters
- Not your friend — This is not a replacement for building real-world relationships with real people
- Not designed to keep you hooked — We built Momentum to help you achieve tasks and make progress, not to encourage endless engagement
- Not a tool for harmful actions — We've built safety controls to prevent Momentum from helping with actions that could harm you or others. Using the app for harmful, dangerous, or illegal purposes is strictly prohibited.
You decide what actions to take. Momentum helps you think it through, but all decisions and their consequences are your responsibility.
4. Important Disclaimers
4.1 Not Professional Advice
Momentum is not a substitute for professional medical, psychological, therapeutic, financial, or legal services. The AI coaching provided is for general personal development and self-reflection purposes only.
If you are experiencing mental health difficulties, emotional distress, or any medical concerns, please seek help from qualified healthcare professionals. In case of emergency, contact your local emergency services immediately.
For financial, legal, or other professional advice, consult appropriate licensed professionals.
4.2 AI Limitations
The AI coach is powered by Anthropic's Claude AI technology. While we strive to provide helpful and accurate responses:
- AI responses may occasionally be inaccurate or inappropriate
- The AI does not have access to real-time information
- The AI coach draws on your saved context (View Coaching Context, View Landscape, Capture History) and your plan to provide responses in each session. If the coach is missing important information, you can update these in your Account settings.
- You should not rely solely on AI advice for important life decisions
4.3 No Guarantees
We do not guarantee any specific outcomes from using Momentum. Personal growth and behaviour change depend on many factors, and results will vary between individuals.
5. Subscriptions and Payments
5.1 Subscription Options
Momentum offers the following subscription options:
- Trial Week (£1): A one-time, non-renewing 7-day access to all features
- Monthly Subscription (£4/month): Auto-renewing monthly access to all features
5.2 Payment Processing
All payments are processed through Apple's App Store. By making a purchase, you agree to Apple's terms and conditions for in-app purchases.
5.3 Auto-Renewal
Monthly subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage your subscription and turn off auto-renewal in your Apple ID account settings.
5.4 Refunds
Refund requests are handled by Apple according to their refund policy. We cannot process refunds directly. To request a refund, visit reportaproblem.apple.com.
5.5 Price Changes
We reserve the right to change subscription prices. Any price changes will be communicated in advance and will not affect your current subscription period.
6. User Responsibilities
When using Momentum, you agree to:
- Not use the App for harmful, dangerous, or illegal activities. By using Momentum, you explicitly agree that you will not attempt to use it to engage in actions that could harm yourself or others. We have built-in safety controls, and attempting to circumvent these is a violation of these Terms.
- Provide accurate information during setup and coaching sessions
- Use the App only for lawful purposes
- Not attempt to reverse engineer, modify, or interfere with the App
- Not use the App to generate harmful, abusive, or illegal content
- Maintain the security of your device and iCloud account
- Take responsibility for backing up your data
7. Intellectual Property
7.1 Our Rights
The App, including its design, features, code, and content (excluding your personal data), is owned by ABOVE BELOW AROUND LIMITED and protected by intellectual property laws.
7.2 Your Content
You retain ownership of all personal content you create within the App (values, milestones, conversations, etc.). We do not claim any ownership rights over your personal data.
7.3 Licence to Use
We grant you a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms.
8. Data and Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Key points:
- Your data is stored on your device and in your personal iCloud account
- We do not have access to your conversations or personal information
- Conversations are processed by Anthropic's AI service to generate responses
- You can delete all your data at any time through the App
9. Service Availability
We strive to keep Momentum available at all times, but we cannot guarantee uninterrupted access. The App may be temporarily unavailable due to:
- Maintenance and updates
- Technical issues with third-party services (AI, iCloud)
- Circumstances beyond our control
We reserve the right to modify, suspend, or discontinue the App at any time with reasonable notice.
10. Limitation of Liability
In plain language: Like most apps, we can't be held responsible for everything that might go wrong. We work hard to make Momentum reliable, but we can't guarantee it will always work perfectly. If something does go wrong, our financial responsibility is limited to what you've paid us in the past year.
The legal details:
To the maximum extent permitted by law:
- The App is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the App in the 12 months preceding any claim
- We are not responsible for data loss resulting from device failure, iCloud issues, or user error
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Termination
11.1 By You
You may stop using the App at any time. To cancel a subscription, manage your settings in your Apple ID account. To delete your data, use the "Delete Account & Data" option in the App.
11.2 By Us
We may terminate or suspend your access to the App if you violate these Terms or engage in behaviour that could harm us or other users.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the App when you next open it. Continued use of the App after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
